Information Collection & Use

Golfer Registration

In order to use this Web site, you must first complete the registration form and create a user name and password. During registration you are required to give contact information, including name, email address, phone number, and home address. We use this information to contact you to further support the services you use within our site. We also share this information with golf clubs from which you request and/or book tee times, so they can contact you if necessary.

You have the option to provide us with demographic information such as club affiliations, gender, birth date, and golf equipment; we encourage you to submit this information so we can provide you a more personalized experience on our site. When you register as a Boxgroove member, you agree to be listed in our Golfer Directory. Please see the “Uses of Information” section regarding what personal information is shared with members and non members.

Upon registration you will automatically be set up to receive our newsletter. We will use your name and email address to send the newsletter to you. Out of respect for your privacy, we provide you a way to unsubscribe. Please see the “Choice and Opt-out” section.

Boxgroove is the sole owner collected on Boxgroove.com. Boxgroove.com collects personally identifiable information from our users at several different points on our Web site.

Club Contact Set-up

In order for a club to use the website they must complete the club contact assignment form. During setup we require the club contact’s name and email address. We use this information to contact the appropriate club employees regarding tee times that are requested, books and cancelled by our golfing members. Club contacts have the option to provide us with phone number information if they choose to be contacted by phone.

Payment for Services

When you purchase memberships and tee times from us, we request certain personally identifiable information from you on our payment form. You must provide contact information such as name and billing address and financial information such as credit card number and expiration date.

We use this information for billing purposes and to fill your orders. For your added protection, we do not store credit card numbers in our system.

Refer-A-Friend

If you choose to use our referral service to tell a friend about our site, we will ask you for your friend’s name and email address. We will automatically send your friend a one-time email inviting him or her to visit the site. Boxgroove.com stores this information for the sole purpose of sending this one-time email and tracking the success of our referral program.

Your friend may contact us at customer.service@boxgroove.com to request that we remove this information from our database.

Gift Memberships

If you choose purchase a gift membership for someone, we will ask you for the recipient’s name, address and email address. This information is collected for the sole purpose of sending the gift certificate and other gift related collateral (e.g. logo golf balls).

If the recipient of the gift chooses not to become a member of Boxgroove, they can contact us at customer.service@boxgroove.com to request that we remove this information from our database.

Inviting Guests to Join Your Booked Tee Time

If you choose to invite non-Boxgroove members (i.e. “guests”) to join you at a tee time booked through Boxgroove, we will ask you for the guests name and email address.

This information is collected in order to communicate with your guest for the following reasons:

  • To send the code of conduct for the club at which the tee time is scheduled. The guest must agree to the code of conduct prior to playing the course.
  • To communicate any changes in status related to the tee time. For instance if the tee time is cancelled, we will contact the guest and let them know.
  • To send the guest the Boxgroove newsletter. Out of respect for their privacy, we provide your guest a way to unsubscribe. Please see the “Choice and Opt-out” section.

Testimonials

For testimonials, we do obtain the customer's consent prior to posting their name along with their testimonial. If you want to remove your testimonial that is being displayed on our website under public pages please see “Contact Us” below.

Contests

From time-to-time we may provide you the opportunity to participate in contests or surveys on our site. If you participate, we will request certain personally identifiable information from you. Participation in these surveys or contests is completely voluntary and you therefore have a choice whether or not to disclose this information. The requested information typically includes contact information such as name and email address, and demographic information such as city and state.

We use this information to notify contest winners and award prizes, to monitor site traffic or personalize the site in the case of anonymous information collected in surveys as well as to send participants an email newsletter.

We may use a third party service provider to conduct these surveys or contests; that company will be prohibited from using our users’ personally identifiable information for any other purpose. We will not share the personally identifiable information you provide through a contest or survey with other third parties unless we give you prior notice and choice.

Uses of Information

When you register with Boxgroove, you create your own profile and privacy settings. By default, your contact information (email, phone, street address) will only be shared with other members of Boxgroove that you specify as “buddies”. You can choose to change these sharing preferences by editing your profile on the “MyProfile” page. Click on the lock symbol next to each field to change your settings. After clicking on the lock symbol you will be given the option to share this information with all members of Boxgroove, no members of Boxgroove, or members that you specify as buddies.

Other “profile” information, including date of birth and gender, which you submit to Boxgroove, can be viewed by any member of Boxgroove. This information helps our members develop relationships and promotes the opportunities for our membership to invite one another to play golf. The profile information also allows our member clubs to know you better, enabling more personalized service at our member clubs.

Your name, city, state and profile picture thumbnail will be available in search results across the Boxgroove network and those limited pieces of information may be made available to third party search engines. This is primarily so your friends can find you and send a friend request. Non Boxgroove members who see your name in searches, however, will not be able to access any additional profile information.

If you do not wish to appear in our Golfer Directory, you may contact us at customer.service@boxgroove.com to request that we remove you from the directory.

Boxgroove may use information in your profile without identifying you as an individual to share with third parties. We do this for purposes such as aggregating how many people in our membership like a particular brand of golf equipment, cigars, etc. This allows us to personalize advertisements and promotions that are appropriate for our members. We believe this benefits you. You can know more about trends within the golfing industry and, where there are advertisements, they're more likely to be interesting to you. For example, if you put a favorite golf balls, we might serve you an advertisement highlighting discounted prices for those golf balls. But we do not disclose your personal information to the golf ball company.

Communications from the Site

Based upon the personally identifiable information you provide us, we will send you a welcoming email to verify your username and password. We will also communicate with you in response to your inquiries to provide the services you request, and to manage your account. We may communicate with you by email or telephone.

Boxgroove may send you service-related emails and/or SMS messages from time to time through the general operation of the service. For instance:

  • A friend sends you a new message
  • A tee time is posted that matches a tee time that you requested
  • A tee time is cancelled by the club or host

Generally, you may opt out of such emails or SMS messages from the tour profile page though Boxgroove reserves the right to send you emails about your account even if you opt out of all voluntary email notifications.

In addition to our newsletter, we will occasionally send you information on products, services, special deals and promotions.

Out of respect for your privacy, we present the option not to receive these types of communications. Please see the “Choice and Opt-out” section of this document.

These messages will always be sent to your Boxgroove mailbox. By default all of these service level messages will be replicated to your email address. Through your profile, you can change these replication settings as follows:

  • Replicate All Messages
  • Replicate Tee Time Messages Only
  • Do Not Replicate Messages

Service related messages can also be replicated to your cell phone if you desire. By default, we do not replicate any messages to your phone. The same replication options listed above are also available for phone.

Supplementation of Information

On occasion, we may need to mail you something to your home address. For instance, your membership purchase may come with a complimentary gift (e.g. logo balls, hat, and golf shirt). In order to ensure the proper delivery of this gift, we use Melissa Data to verify your address.

Some of our clubs want to know the number of miles between your home and the club. They may use this information to offer you special offers or to limit the number of times that you can play at their club in a given year. In order to support these capabilities we use Melissa Data to determine the latitude and longitude of your home address.

Information Sharing and Disclosure

Aggregate Information (non-personally identifiable)

We may share aggregated demographic information about our user base with our golf clubs and advertisers. This information does not identify individual users. We do not link aggregate user data with personally identifiable information.

Personally Identifiable Information:

We Share Personally Identifiable Information (name, address, and phone number) with golf clubs from which you request and/or book tee times. This allows participating clubs to contact you about tee times and tee time requests when necessary. The club may also choose to contact you regarding membership at their club.

Agents/Service Providers

We use a payment processor (First Data) to handle credit card payments. When you purchase a membership or tee time, we will submit your name, address and credit card information as necessary for First Data to process your payment.

We use an email service provider (Constant Contact) to send out newsletter emails on our behalf. When we send a newsletter we send your email to Constant Contact so they can send the email and capture email addresses that choose to opt out of our newsletter.

We use a third party live help service (Live!Zilla) to assist you if you have questions while using our site or regarding your order. When you use live help, we will share your email address as necessary for the third party to provide that service.

These third parties are prohibited from using your personally identifiable information for promotional purposes.

We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on our Web site.

Choice/Opt-out

Sharing with Third Parties for Marketing Offers

We currently do not share your personally identifiable information with any 3rd party, except golf clubs from which you request and/or book tee times. However, from time to time we may partner with other companies to provide special offers to our members. Some of these third parties may request personally identifiable information. Therefore, we provide you the opportunity to ‘opt-in’ to have your personally identifiable information shared with these third parties. If you choose to opt-in when you register, you can change your preference from your profile page at any time.

Newsletter

If you no longer wish to receive our newsletter and promotional communications, you may opt-out of receiving them by following the unsubscribe instructions included in each newsletter or communication or by emailing us at customer.service@boxgroove.com

Marketing Emails

We may send you emails regarding special offers for products and services provided by Boxgroove or one of our marketing partners. However, you may opt-out of these communications by changing your email opt-out preference from your “My Profile” page.

Log Files

Welcome to Boxgroove.com. These End User Terms and Conditions govern your use of Boxgroove.com (the “Site”) and the Boxgroove.com service (the “Service”). By clicking “accept” you agree to abide by these End User Terms and Conditions and any modifications that may be made to the End User Terms and Conditions (collectively, the “Terms”) from time to time; if at any time you do not agree to these Terms you should not use the Service, or visit or browse the Site.

These Terms constitute a binding legal agreement between you and Boxgroove.com, LLC (“Boxgroove.com,” “we,” “us,” and “our”). Please read them carefully before accepting.
  1. Modifications to Terms

    Boxgroove.com reserves the right to change or modify any of the terms and conditions contained in these Terms, and any other Boxgroove.com terms, policies, or guidelines, at any time and in its sole discretion. Any changes or modifications will be effective immediately upon posting of the revisions on the Site. Your continued use of the Site following the posting of such changes or modifications will constitute your acceptance of such changes or modifications. If Boxgroove.com updates these Terms, it will update the “last updated” date above.   2. Copyright and Limited License

    If you comply with all the terms and conditions of these Terms, Boxgroove.com, grants you a revocable, non-transferable, and non-exclusive license to access the Site and to electronically copy (except where prohibited without a license) and print to hard copy portions of the Content for your informational, personal, and non-commercial purposes only. This license is revocable at any time.

  3. Registration Data; Account Security

    You must register for and maintain an account to use the Service. You agree to (a) provide accurate, current and complete information about you as may be prompted by registration forms on the Site (“Registration Data”); (b) maintain the security of any logins, passwords, or other credentials that you select or that are provided to you for use on the Site; and (c) maintain and promptly update the Registration Data, and any other information you provide to Boxgroove.com, and to keep all such information accurate, current, and complete. You will notify us immediately of any unauthorized use of your account or any other breach of security.
  4. Fees for Service and Payment Terms

    The current rate for the Service is US $49 per year. You acknowledge that fees for the Service shall be paid in advance on an annual basis, that the Service will may not be initiated until payment is received and processed by Boxgroove.com, and that the third party payment platform provider(s) we use to process payment hereunder may have their own terms and conditions. All fees are exclusive of applicable sales, excise, or use taxes. If Boxgroove.com does not receive payment from your credit card provider or the payment processor for any reason, you will pay all amounts due upon demand and Boxgroove.com may cancel your account. You are solely responsible for any and all fees charged to your credit card by the issuer, bank, or financial institution including, but not limited to, membership, overdraft, insufficient funds, and over the credit limit fees. Boxgroove.com reserves the right to change the fees, charges, and payment terms for any such renewal period, provided that in the event of any change Boxgroove.com shall prompt you to accept any such amended terms in connection with the renewal process. Boxgroove.com will notify you by email 14 days before the expiration of your annual term. If have opted to use Boxgroove.com’s auto renewal feature and do not cancel the Service via the cancellation link in the email or in your account settings on the Site by the last day of the then current term, your membership will automatically renew on the credit card you have provided for your use of the Service. You may opt-out of automatic renewal at anytime by visiting your account settings.
  5. User Obligations

    You understand that the Service does not guarantee tee time availability. There may be no tee times available in a certain area or at a certain time. You may use the Service to browse for tee times that may be made available by the member courses or you may request specific tee times from other users or from member clubs.

    By offering a tee time or making a tee time reservation through the Service, you:
    1. agree to comply with any club-specific identification requirements (e.g. proof of course affiliation, proof of alumni affiliation for university courses). If you do not comply, the course may refuse to honor your tee time, the entire greens fee for all rounds reserved and any pre-paid incidentals may be forfeited.
    2. agree to comply with any cancellation policies set forth by individual clubs. If you do not cancel your reservation in accordance with the course cancellation policy, the course may charge your credit card the entire greens fee for all rounds reserved, including any associated pre-paid incidentals.
    3. agree to follow all course rules while playing rounds booked through the Service.
    4. authorize Boxgroove.com to share your name, address, E-mail address and contact phone number with the golf course at which you make each tee time. Boxgroove.com will process all greens fees.
    5. assume all risk and danger incidental to the game of golf, including specifically (but not exclusively) the danger of being injured by errant golf balls and clubs, and agree that Boxgroove.com, the member courses, and their employees are not liable for injuries resulting from such causes.
    6. if hosted by a country club member, will work with the hosting golfer to coordinate payment of greens fees in accordance with the associated club’s code of conduct and/or bylaws.
    7. if acting as a host golfer, agree to host guest golfers and coordinate payment of greens fees in accordance with your specific club’s code of conduct and/or bylaws.

    During the term of this Agreement, you will not arrange for, or in any way collude, directly or indirectly, with any member club in the Boxgroove.com program, to play a member club’s golf course(s), other than through the Service; provided, however, that you may solicit information on and become a golf member of a member club.
  6. Advertisements and Promotions

    The Site may contain advertisements and promotions from third parties. Your business dealings or correspondence with, or participation in promotions of, advertisers other than Boxgroove.com, and any terms, conditions, warranties, or representations associated with such dealings, are solely between you and such third party.
  7. Interactive Services

    The Site may include interactive features and services, including social networking functionality, chat rooms and forums, message boards, ratings or review functionality, and similar services, in which you or third parties may send messages to Site users, and create, post, or store profile data, pictures, ratings or reviews, and other Content on the Site (“Interactive Services”). You are solely responsible for your use of Interactive Services and use them at your own risk. By using any Interactive Services, you agree not to post, transmit, distribute, upload, or otherwise disseminate through the Site any of the following:
    • Materials that is unlawful, libelous, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory, or fraudulent;

    • Private or confidential information of any third-party (whether a person or entity), including, without limitation, addresses, phone numbers, email addresses, Social Security numbers, credit card numbers, and any trade secrets or information for which you have any obligation of confidentiality or material that impersonates any person or entity, or misrepresents your affiliation with the Site or with any other person or entity;
    • Material that is or contains any advertising or solicitation, including, without limitation, links to commercial products or services or any political campaigning (except in portions of the Site that are expressly designated as portions in which such Material is allowed);
    • Viruses, corrupted data, or other harmful, disruptive, or destructive files; or
    • Material that, in the sole judgment of Boxgroove.com, is objectionable, restricts or inhibits any person or entity from using or enjoying any Interactive Services or other portions of the Site, or which may expose Boxgroove.com, the Site, or its users to harm or liability of any nature.

    Boxgroove.com takes no responsibility and assumes no liability for any material posted, stored, or uploaded by you or any third party, or for any loss or damage thereto, nor is Boxgroove.com liable for any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography or profanity you may encounter on the Site or in your dealings with other Site users.

    Although Boxgroove.com has no obligation to screen, edit, or monitor any material posted on or transmitted through the Site, Boxgroove.com reserves the right, and has absolute discretion, to remove, screen, and edit any material posted, stored, or transmitted on or through the Site at any time and for any reason without notice.

  8. Dealings with Site Users

    Your transactions, dealings, and correspondence with, or participation in promotions of, persons who place, respond to, or are named or referenced in, any Opinions, Content or other materials, and any terms, conditions, warranties, or representations associated with such transactions, dealings, and correspondence, are solely between you and such third party. Boxgroove.com is not responsible or liable for any loss or damage of any sort incurred as the result of any such dealings, transactions, or correspondence. If you enter into any kind of transaction with a Site user or other third party, Boxgroove.com and its subsidiaries and affiliates are not responsible or liable for any action or inaction of you or any other party to such a transaction.
  9. Submissions

    You acknowledge and agree that any materials, including but not limited to questions, comments, suggestions, ideas, plans, notes, drawings, original or creative materials, or other information, provided by you in the form of email or other submissions to Boxgroove.com (excluding material that you post on the Site in accordance with these Terms), are non-confidential and shall become the sole property of Boxgroove.com. Boxgroove.com will own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these materials for any purpose, commercial or otherwise, without acknowledgment or compensation to you.
  10. Repeat Infringer Policy
